A Michigan man faced felony charges, 5 years in prison, for reading his wife's e-mail. Leon Walker a 33-year-old used his wife's Google Gmail account password to log into her e-mail on a laptop the couple shared in their home in the city of Rochester Hills. In her inbox, he learned she was having an affair, immediately she filed for divorce and dragged him to court. Reading a spouse's emails may be a privacy violation if there is no consent. The 1980 Michigan statute (Computer law) states as follows:

"A person shall not intentionally access or cause access to be made to a computer program, computer, computer system, or computer network to devise or execute a scheme or artifice with the intent to defraud or to obtain money, property, or a service by a false or fraudulent pretense, representation, or promise. "

Such conviction will not hold in a state like Texas.
